WHEREAS, Section 1-7-2(C) of the Simla Municipal Code provides that if the only matter before the voters is the election of persons to office; and if, at the close of business on 64th day before the election (February 1, 2022) there are not more candidates than offices to be filled at such election, including candidates filing affidavits of intent, the Town Clerk, if instructed by the Board of Trustees, may cancel the election and the Board of Trustees may declare the candidates elected; and
WHEREAS, there was only one candidate for election to the Town Board of Simla for the three offices available as of April 5, 2022. Only one candidate for the Mayor position available April 5, 2022.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF SIMLA, COLORADO;
1. THAT TOWN CLERK JACKIE L. ZION IS AUTHORIZED TO CANCEL THE APRIL 5, 2022 SIMLA MAYOR/TRUSTEE MUNICIPAL ELECTION.
2. SINCE THE MAYOR/TRUSTEE ELECTION IS CANCELED, THE FOLLOWING CANDIDATES FOR OFFICE LISTED BELOW FOR THE TOWN OF SIMLA SHALL BE DECLARED ELECTED FOR THE TERM COMMENCING ON APRIL 12, 2022
RYAN FULMER MAYOR – FOUR (4) YEAR TERM
JANETTE NIPPLE TRUSTEE – FOUR (4) YEAR TERM
3. THE TOWN CLERK AS DESIGNATED ELECTION OFFICIAL SHALL PUBLISH THIS RESOLUTION AND POST A COPY AT THE POLLING PLACE AND IN NOT LESS THAN ONE OTHER PUBLIC PLACE.
